The birth or adoption of a child is an exciting time for parents. For employees in New Zealand the Parental Leave and Employment Protection Act 1987 (the Act) sets out these minimum entitlements and is designed to protect the rights of employees during pregnancy and parental leave. In addition, the Act sets out the rules regarding paid parental leave.

Before employees can take parental leave, whether paid or unpaid, they must provide advice in writing at least three months before the due date, or at least 14 days prior to the date they expect to first assume care of a child under the age of six.

There are rules relating to eligibility for the different types of leave and when the leave is allowed to be taken.
